Overview

Welcome to Nutrifarm. In these Terms of Service (the "Terms"), the words "we", "us", and "our" refer to Nutrifarm, and the words "you" and "your" refer to the customer or website visitor. These Terms describe your rights and responsibilities when you use this website or place an order with us. By accessing this site or submitting an order, you agree to be bound by these Terms and by our Privacy Policy, Refund Policy, and Shipping Policy, each of which is incorporated by reference. If you do not agree to any part of these Terms, please do not use this website and do not place an order.

We may update these Terms from time to time. The version in effect is always the one posted on this page, with the "Last updated" date shown at the bottom.

1. Access and eligibility

You must be of legal age (at least 18 years old in the Philippines) and able to enter into a binding contract to place an order with us. By using this site, you represent and warrant that you meet this age requirement and that the information you provide, including your name, mobile phone number, delivery address, and any other details, is accurate, current, and complete.

You are responsible for keeping your contact details and devices secure. You are also responsible for all activity that takes place under the contact details you provide, including orders placed using your name and number. You may not assign or transfer any order or claim under these Terms to another person without our written consent.

2. Our products

Nutrifarm sells animal health medicines and nutritional supplements intended for livestock, poultry, gamefowl, swine, cattle, goats, sheep, and other farm or companion animals. Each product is labeled with recommended indications, dosage, and storage requirements. You agree to:

  • Read and follow the label, indications, and dosage instructions on each product
  • Store products according to the instructions (for example, away from direct sunlight and extreme heat)
  • Consult a licensed veterinarian for serious, unusual, or unclear animal health concerns, especially for pregnant animals, very young animals, or animals with existing conditions
  • Follow all withdrawal periods stated on the label before slaughter or milk/egg collection, where applicable
  • Not use our products in a way that violates any Philippine law or local regulation

Product photos on this website are for reference. Actual colors, labels, and packaging may vary slightly due to lighting, screen calibration, or manufacturer packaging updates. We do not warrant that the appearance of any product will be exactly as shown. Product descriptions, indications, dosage, and stock levels may be updated at any time without prior notice. We reserve the right to discontinue or limit the availability of any product.

3. Orders and acceptance

When you submit an order on this website, you are making an offer to purchase the selected items at the stated price. Your order is not final until our team confirms it with you via Messenger, SMS, or phone call. At our sole discretion, we may decline or cancel any order, including:

  • When an item is out of stock
  • When the delivery address is outside our courier's serviceable area
  • When we suspect fraudulent, abusive, or resale activity
  • When the quantity ordered exceeds what a normal end-user would need
  • When the information you provided appears inaccurate or incomplete

Products on this website are intended for personal and on-farm use only. You may not purchase from us for commercial resale or redistribution without our prior written consent.

4. Pricing and payment

All prices on this website are shown in Philippine Pesos (PHP) and may change at any time. The price that applies to your order is the price displayed on the site at the time you submit the order. Prices include applicable taxes unless stated otherwise. Shipping fees follow our Shipping Policy.

All orders on this website are Cash on Delivery (COD). You pay the courier in cash when your parcel arrives. We do not collect credit card numbers, debit card numbers, online banking credentials, or any payment credentials on this site. Any request for upfront online payment that claims to come from Nutrifarm outside of our official Messenger or email channels should be treated as suspicious and reported to us immediately.

Promotions, discounts, and bundle prices are subject to change without notice and may have additional conditions (minimum quantity, specific SKUs, time windows) stated on the promo itself.

5. Shipping and delivery

Delivery details, processing times, courier partners, and fees are covered in our Shipping Policy. Once a parcel is handed to the courier, delivery times are estimates only and may be affected by weather, courier capacity, remote addresses, or government-declared holidays. Title and risk of loss pass to you upon delivery to the address you provided. We are not liable for courier delays outside our control, although we will help you follow up with the courier whenever possible.

6. Returns and refunds

Returns, replacements, and refunds are governed by our Refund Policy. In summary: unopened products that are damaged in transit, faulty, or wrongly shipped may be returned or replaced if reported within 7 days of delivery, with supporting photos. Opened or used products cannot be refunded for health and safety reasons, except where a clear manufacturing defect can be demonstrated.

7. Intellectual property

All content on this website, including text, graphics, logos, product names, photographs, illustrations, icons, layouts, and designs, is owned by Nutrifarm or used with permission. The Nutrifarm name and logo are trademarks of Nutrifarm. You may view and use this site for personal, non-commercial purposes only. You may not:

  • Copy, reproduce, republish, or redistribute our content
  • Modify or create derivative works based on our content
  • Sell, license, rent, or commercially exploit any part of this site
  • Scrape, data-mine, or extract content using automated tools
  • Use our trademarks or product names in a way that could confuse customers about the source of a product

All rights not expressly granted in these Terms are reserved by Nutrifarm.

8. Acceptable use

You agree not to:

  • Use this website for any unlawful, fraudulent, or misleading purpose
  • Place orders using a false identity or another person's details without their consent
  • Interfere with or disrupt the website, servers, or networks used to deliver the service
  • Attempt to gain unauthorized access to our systems or to any customer's information
  • Upload, transmit, or distribute viruses, malware, or any malicious software
  • Harass, abuse, threaten, or defame our staff, couriers, or other customers
  • Copy or scrape our product list, pricing, or photos for a competing website
  • Resell our products without our written consent or in a way that misrepresents them
  • Submit fake reviews, fake testimonials, or misleading claims about our products

We may suspend, restrict, or refuse service to any user who breaches these rules, at our sole discretion and without prior notice.

9. Accuracy of information

We do our best to keep product information, prices, and stock status accurate and up to date. From time to time, however, the site may contain typographical errors, inaccuracies, or outdated information (for example, an incorrect price, a wrong stock status, or an outdated indication). We reserve the right to correct any errors, update information, and cancel or amend orders based on the corrected information, even after you have submitted an order and received an on-screen confirmation.

10. Third-party links and services

Our website and marketing materials may include links to third-party sites and services, such as our Facebook page, Messenger chat, GCash, and courier tracking pages. We are not responsible for the content, accuracy, security, or privacy practices of those third-party services. Accessing them is at your own risk, and their own terms and privacy policies apply.

11. User content and feedback

If you send us any ideas, suggestions, feedback, reviews, testimonials, photos, videos, or other content (collectively, "Feedback"), you grant Nutrifarm a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display the Feedback in any media, including marketing materials and our Facebook page, with attribution where practical. You warrant that you own or have the right to give us this license, and that your Feedback does not infringe any third-party rights. We are not required to keep Feedback confidential, to pay compensation for Feedback, or to respond to Feedback.

12. Disclaimer of warranties

This website and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by Philippine law, Nutrifarm makes no representations or warranties of any kind, express or implied, about the operation of this site or the information, content, or products included on it, except as expressly stated on the product label.

Animal health outcomes depend on many factors beyond our control, including proper storage, correct dosage for the animal's weight and condition, general animal health, environment, and husbandry practices. We do not guarantee specific results (such as weight gain, egg production, or recovery time) from the use of any product. Always follow label directions, respect withdrawal periods, and consult a licensed veterinarian for serious or unusual animal health concerns.

13. Limitation of liability

To the fullest extent permitted by Philippine law, Nutrifarm and its owners, officers, employees, and partners are not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to your use of this website or our products, including, without limitation, loss of profit, loss of production, loss of animals, loss of data, replacement costs, or any similar damages, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim related to an order is strictly limited to the amount you actually paid for that specific order. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold Nutrifarm, its owners, officers, employees, and partners harmless from and against any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; (c) your use or misuse of any product bought from us; or (d) any content or information you submit to us or post about us.

15. Termination and suspension

We may suspend or terminate your access to this website or to Cash on Delivery service, in whole or in part, at any time and at our sole discretion, without prior notice, if we believe you have violated these Terms, abused our service, or caused losses to Nutrifarm or our courier partners. Sections 7 (Intellectual Property), 11 (Feedback), 12 (Disclaimer), 13 (Limitation of Liability), 14 (Indemnification), and 18 (Governing Law) survive any termination.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.

17. Waiver and entire agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Nutrifarm regarding the use of this website and the purchase of our products, and supersede any prior or contemporaneous agreements, whether written or oral.

18. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms, this website, or your use of our products shall be settled in the proper courts of Nueva Ecija, Philippines, to which you consent by using this site or placing an order.

19. Changes to these Terms

We may update these Terms of Service at any time. Updates take effect on the date they are posted on this page. We will update the "Last updated" date below and, where material, announce changes on our official Facebook page. Your continued use of this website after changes are posted means you accept the revised Terms.
